SOHOUSE Terms & Conditions

These Terms & Conditions apply to purchases made from SOHOUSE Gifts (“SOHOUSE”, “we”, “us” or “our”) through our website, by email, invoice or through any other ordering method.

By placing an order with SOHOUSE, you agree to these Terms & Conditions.

1. Orders

All orders are subject to acceptance and product availability.

An order is considered confirmed once payment, or any required deposit, has been received and we have accepted the order.

For custom, branded or bulk orders, additional requirements including minimum order quantities, deposits, artwork approval and production timeframes may apply. These will be communicated before or during the ordering process.

We reserve the right to decline or cancel an order where we are unable to fulfil it, there has been an obvious pricing or product error, payment has not been received or circumstances outside our reasonable control prevent fulfilment. If we cancel an order after payment has been received, the amount paid for the cancelled order will be refunded unless otherwise agreed with you.

2. Pricing & Payment

All prices are displayed in Australian dollars (AUD).

Any applicable delivery, customisation or other charges will be displayed or communicated before the order is confirmed.

Payment must be received in accordance with the payment terms provided at checkout or on your invoice.

Where a deposit is required for a custom or bulk order, production may not commence until the required deposit has been received.

3. Product Availability & Substitutions

Our gifts contain products sourced from a range of Australian and New Zealand brands and suppliers. Product availability may occasionally change without notice.

Where a particular product becomes unavailable, we may contact you to discuss a suitable substitute. Where appropriate and permitted by law, we may substitute an unavailable item with another item of similar type, quality and value while maintaining the overall presentation and value of the gift.

Where a particular product, brand, colour or variation is essential to your order, please contact us before placing your order.

Product packaging may also change from time to time due to changes made by individual suppliers.

4. Product Images

We make every reasonable effort to ensure our website photographs and product descriptions accurately represent our gifts.

Due to differences in screens, photography, lighting, natural materials, supplier packaging and product availability, colours and presentation may vary slightly from images shown.

Styling items or props shown in photographs are not included unless specifically stated in the product description.

5. Custom Branding

SOHOUSE offers custom branding on selected products and packaging.

Customers are responsible for supplying accurate, suitable and sufficiently high quality logos, artwork, names, wording and other branding materials.

By providing us with a logo, trademark, artwork or other material, you confirm that you own it or have permission to use it and authorise SOHOUSE and our suppliers to reproduce it for the purpose of completing your order.

You are responsible for ensuring that all spelling, names, logos, colours and other details supplied to us are correct.

Where we provide an artwork proof for approval, production may commence once the proof has been approved. Please check proofs carefully. Changes requested after approval may result in additional charges or production delays.

SOHOUSE is not responsible for errors contained in artwork or information supplied or approved by the customer, except to the extent that responsibility cannot legally be excluded.

Colours displayed digitally may vary slightly from the finished printed or branded product.

6. Minimum Order Quantities

Certain custom branded products, packaging and corporate gifting options have minimum order quantities.

The applicable minimum quantity will be displayed on the relevant product, communicated in your quote or confirmed before your order proceeds.

Minimum order quantities may vary depending on the product and branding method.

7. Bulk & Corporate Orders

Bulk and corporate orders may be subject to separate quotes, deposits, production schedules and delivery arrangements.

Where gifts are being delivered at different times or to multiple recipients, additional delivery charges may apply.

Any estimated production or delivery timeframe begins once all information required from the customer has been received, including payment or deposit, recipient details, branding files and artwork approval where applicable.

8. Changes & Cancellations

If you need to change or cancel an order, please contact SOHOUSE as soon as possible.

We will make reasonable efforts to accommodate changes before an order has entered preparation or production.

However, once products have been ordered specifically for your order, branding has commenced, custom packaging has been produced or your order has otherwise entered production, we may be unable to accommodate a change or cancellation.

For custom or personalised products, amounts already reasonably incurred in producing or sourcing the order may not be refundable where permitted by law.

Nothing in this section limits any rights you have under the Australian Consumer Law.

9. Change of Mind

Please choose carefully.

SOHOUSE is not required to provide a refund or exchange where you simply change your mind, no longer require the products, ordered the incorrect product or quantity, or find the product cheaper elsewhere.

We may choose to accommodate a change-of-mind request at our discretion where an order has not yet been prepared, personalised or dispatched.

This policy does not limit your rights under the Australian Consumer Law.

10. Shipping & Delivery

SOHOUSE offers delivery and shipping to eligible Australian locations as displayed at checkout or otherwise agreed with you.

Delivery timeframes are estimates only and may be affected by courier networks, weather, peak periods, regional locations and other circumstances outside our reasonable control.

Once an order has been dispatched, delivery is handled by the relevant courier or delivery provider. We will provide reasonable assistance if a delivery issue occurs.

Customers are responsible for providing complete and accurate delivery details.

Where an incorrect or incomplete address is supplied, or a delivery cannot be completed due to circumstances attributable to the recipient or customer, additional redelivery or return charges may apply.

Authority to leave may apply to certain deliveries. Where an order is left in accordance with the customer's or recipient's delivery instructions, responsibility for the parcel will be subject to applicable law and the terms of the relevant delivery provider.

11. Delivery Dates

If you require delivery by a particular date, please contact us before ordering.

We will always make reasonable efforts to meet requested delivery dates, however courier and freight delivery dates cannot be guaranteed unless we expressly agree otherwise.

SOHOUSE is not responsible for delays outside our reasonable control, but this does not exclude any rights or remedies available under Australian law.

12. Damaged, Faulty or Incorrect Orders

Please contact us as soon as reasonably possible if your order arrives damaged, faulty or materially different from what you ordered.

To help us assess the issue quickly, we may request your order number, photographs of the product and packaging and any other relevant information.

Where goods fail to meet a consumer guarantee under the Australian Consumer Law, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

13. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law where the Australian Consumer Law applies.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies available to you under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other applicable legislation where those rights cannot legally be excluded.

14. Alcohol

Some SOHOUSE gifts may contain alcoholic beverages.

Alcohol containing gifts must only be purchased by persons legally permitted to purchase alcohol and must not be purchased for delivery to a person under 18 years of age.

Customers are responsible for ensuring that the intended recipient is legally permitted to receive alcohol.

Delivery of alcohol containing gifts may be subject to additional carrier, identification, licensing and delivery requirements.

SOHOUSE reserves the right to refuse or cancel an alcohol containing order where fulfilling the order would breach applicable law or delivery requirements.

15. Gift Messages & Recipient Information

Customers are responsible for ensuring recipient names, addresses, contact details and gift messages are accurate before submitting an order.

SOHOUSE is not responsible for errors resulting from incorrect information supplied by the customer, except to the extent required by law.

16. Promotions & Discount Codes

Promotional offers and discount codes may be subject to specific conditions, including expiry dates, minimum spends and product exclusions.

Unless otherwise stated, promotional offers cannot be combined.

SOHOUSE may withdraw or amend a promotion where reasonably necessary, subject to any rights already accrued by customers and applicable law.

17. Intellectual Property

Unless otherwise stated, the content on the SOHOUSE website, including SOHOUSE branding, photographs, graphics, written content and design elements, is owned by or licensed to SOHOUSE and is protected by applicable intellectual property laws.

You may not reproduce, distribute or commercially use our content without prior written permission.

Third party trademarks and brand names displayed in connection with products remain the property of their respective owners.

18. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

To the extent permitted by law, SOHOUSE is not liable for indirect or consequential loss arising from circumstances outside our reasonable control.

Where liability can lawfully be limited, our liability will be limited to the extent permitted by applicable law.

19. Privacy

SOHOUSE may collect personal information necessary to process orders, arrange delivery, communicate with customers and operate our business.

Personal information will be handled in accordance with applicable Australian privacy laws and our Privacy Policy.

20. Changes to These Terms

We may update these Terms & Conditions from time to time.

The Terms applicable to an order will generally be those published or otherwise provided to you at the time the order is placed, unless a change is required by law.

21. Governing Law

These Terms & Conditions are governed by the laws of Queensland, Australia.

The parties submit to the jurisdiction of the courts and tribunals of Queensland and any courts entitled to hear appeals from them, subject to any rights that cannot lawfully be excluded.
